ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY

Whereas, the undersigned acknowledges the novel coronavirus ("COVID-19") constitutes a health risk andgovernment and health agencies recommend social distancing and have, in many locations, prohibited certaingatherings of people. Whereas, the undersigned understands that the Borough of Pleasant Hills cannot guaranteethat anyone, including the undersigned, will not become infected with COVID-19. Whereas, the undersignedhereby acknowledges that attending any program or activity at any of the Borough Park Shelters, Playgroundsand Athietic Fields could increase such person's risk of contracting COVID-19.

With all this in mind, the undersigned does hereby agree that, by signing this agreement, their organizationacknowledges the contagious nature of COVID-19 and voluntarily assumes the risk that they or any member oftheir organization may be exposed to or infected by COVID-19 while on Borough Property and that such exposureor infection may result in certain unfavorable results, including, but not limited to, personal injury, illness,permanent disability, and/or death. By signing this agreement, the undersigned does hereby acknowledge thatthey understand that the risk of becoming exposed to or infected by COVID-19 on Borough Property may resultfrom the actions, omissions, or negligence of themself and others, including, but not limited to, Borough ofPleasant Hills employees, volunteers, and program participants and their families.

The undersigned does hereby agree that they and their organization voluntarily agree to assume al of theforegoing risks and accept sole responsibility for any and all injuries, damages or losses to themselves (including,but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability or expense, of any kind)that they may experience or incur in connection with their attendance and/or utilization of the Borough Property.On behalf of their organization, the undersigned does hereby agree to release the Borough of Pleasant Hills, theappointed and elected officials of the Borough, employees, agents, representatives, Council Members, policeofficers, public officials, including, but not limited to, the Borough Manager and/or Zoning Officer from any andall claims of any nature, including, but not limited to, personal injury or death arising out of the use of the BoroughProperty. Further, the undersigned on behalf of themselves and their organization agrees to indemnify, defendand hold the Borough harmless from any and all claims of any nature arising out of use of the Borough Property.

It is hereby recognized and agreed to that the undersigned and their organization voluntarily assume the risk ofall injury and loss arising out of the use of the Borough Property. This release is intended to be broad in scopeand apply to any claim of any nature arising out of or involving the use of the Borough Property. The totalconsideration for this release is the undersigned's permission to use Borough Property by the Borough. TheBorough hereby makes no other warranties and representations as this agreement constitutes the entireunderstanding between the parties. The undersigned and their organization also agree to have al of theirparticipants sign a waiver agreeing to all of these material terms when hosting events, and in which theundersigned and their participants agree to adhere to all current Center for Disease Control recommendations,orders from the Governor and Commonwealth Secretary of Health, including, but not limited to, those requiringsocial distancing and face coverings, orders from Allegheny County, including, but not limited to, those placinglimitations on the number of persons allowed to attend events, and any Federal/State requirements that may be inplace prior to and at the time the undersigned signs this waiver and those that are put in place after the undersignedsigns this waiver.
